Form 8938 & Specified Foreign Financial Assets

Form 8938 is filed with your federal income tax return, not separately with FinCEN. Reportable assets can include foreign financial accounts and certain foreign stocks, securities, entity interests or financial contracts held outside an account, subject to the IRS rules and exceptions.

An individual who is not required to file an income tax return generally does not have to file Form 8938. Assets reported on certain other forms may qualify for reporting coordination rules, but those forms do not automatically eliminate all Form 8938 obligations.

Residence, Filing Status & Entity Rules

The tables below show individual thresholds. The higher amounts for taxpayers living abroad require the IRS foreign-residence criteria, not simply a foreign mailing address. We review your tax home and the applicable bona fide residence or physical presence requirements.

Certain specified domestic entities also have Form 8938 requirements. The individual filing-status tables should not be used as an entity eligibility test; entity status and reporting thresholds need a separate review. A visa category alone does not establish U.S. tax residency.

Coordinating FATCA, FBAR & Prior-Year Filings

Form 8938 and the FBAR use different asset definitions and thresholds, so both may apply to the same accounts. Foreign mutual funds and other PFIC holdings may also need Form 8621.

Missing Form 8938 can result in penalties and other tax consequences. We review prior-year omissions and available correction procedures based on your facts, without guaranteeing penalty relief.

Form 8938 (FATCA) Filing Thresholds

Form 8938 is required only when the total value of your specified foreign financial assets exceeds the reporting threshold for your filing status and residence. If any threshold below is met, you must file.

Taxpayers living in the United States

Filing statusMore than, on the last day of the tax yearMore than, at any time during the year
Single or Married Filing Separately$50,000$75,000
Married Filing Jointly$100,000$200,000
Head of Household$50,000$75,000

Taxpayers living abroad

Filing statusMore than, on the last day of the tax yearMore than, at any time during the year
Single, Married Filing Separately or Head of Household$200,000$300,000
Married Filing Jointly$400,000$600,000

To whom FATCA applies

  • U.S. citizens
  • Lawful permanent residents (Green Card holders)
  • Resident aliens for tax purposes — including those meeting the substantial presence test, such as H-1B and L-1 visa holders
  • Certain domestic entities formed or availed of to hold foreign financial assets

These thresholds can change by tax year — always confirm the amounts for the year you are filing. For the current requirements, see the official IRS Instructions for Form 8938. Thresholds are based on the total value of specified foreign financial assets, and higher thresholds apply to taxpayers living abroad. Form 8938 is separate from the FBAR — many taxpayers must file both for the same accounts. We review the thresholds that apply to your specific situation.
